This Privacy Policy (“Policy”) describes how your personal data is collected, used, and shared when you visit or make a purchase from www.caramelmonster.com (the “Site”). This Policy sets out the basis where we may collect, use or otherwise process personal data in accordance with the Personal Data Protection Act (“PDPA”).

As used in this Policy, “Personal Data” means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which we have or is likely to have access.

This Policy does not apply to aggregated information that summarises statistical information about groups of members and does not include name, contact information, or any other information that would allow any particular individual to be identified.

1) PERSONAL DATA WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers for VISA and MASTER, relevant information for PAYNOW and PAYLAH), email address, and phone number. We refer to this information as “Order Information.”

 “Personal Data” in this Policy includes both Device Information and Order Information.

We may use cookies to enhance your experience using the Site. These cookies are carefully selected to protect your privacy.

You can block cookies through your browser settings as described above. You may delete the cookies at any time, but deleting cookies might affect website performance and preferences.

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we may use this Order Information for any of the following:

  • Communicate with you;
  • Screen our orders for potential risk or fraud; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

Additionally, we use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Where your use of the Site is concerned, you acknowledge and accept that certain functions when activated or used by you will operate to send or display information of yourself including but not limited to the sharing of personal data to third parties. You acknowledge and agree that we shall not be held responsible or accountable for any loss, injury or damage sustained by you for sharing the aforesaid information arising out of your activation or use of such features on the Site.

3) DISCLOSURE OF YOUR PERSONAL DATA

We may disclose your Personal Data:

(a) to enforce our Site’s Terms of Use, (b) to fulfill our obligations in connection with our provision of the Site; (c) to third party service providers, or (d) if required by any applicable law.

We share your Personal Data with third parties to help us use your Personal Data, as described above. As described above, we use your Personal Data to provide you with targeted advertisements or marketing communications we believe may be of interest to you. 4) PERSONAL DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

We will retain Personal Data in accordance with the PDPA. We will cease to retain your Personal Data when we have reasonably determined that (i) the purpose for which the Personal Data was collected for is no longer being served its retention; (ii) retention is no longer necessary for any legal or business purposes; and (iii) no other legitimate interests warrant further retention of such Personal Data.

If you cease using the Site, we may continue storing, using and/or disclosing your Personal Data in accordance with this Policy and our obligations under the PDPA, and we may securely dispose of your Personal Data without prior notice to you.

5) WITHDRAWING YOUR CONSENT

The consent you provide for the collection, use and disclosure of your personal data will remain valid until you withdraw it in writing. You may withdraw consent and request that we stop collecting, using and/or disclosing your Personal Data for any of the purposes listed above by submitting your request in writing or via email to the contact details provided below.

Upon receipt of your written request to withdraw your consent, we may require a reasonable time (depending on the complexity of the request) to process your request and for us to notify you of the consequences of us complying with it. In general, we shall seek to process your request within fourteen (14) business days of receiving it. Depending on the nature and scope of your request, we may not be in a position to continue providing our Site to you and we shall, in such circumstances, notify you before completing the processing of your request. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.

6) TRANSFERS OF PERSONAL DATA OUTSIDE SINGAPORE

We generally do not transfer your Personal Data outside of Singapore. However, if we do, we will obtain your consent for the transfer and implement measures to ensure that your personal data continues to receive a standard of protection that is at least comparable to that provided under the PDPA.

7) CORRECTION AND REQUESTING ACCESS OF PERSONAL DATA

We generally rely on Personal Data you provide. If you wish to ensure that your Personal Data is current, complete and accurate, please update us if there are changes to your personal data by informing us at the contact details provided below. We reserve the right at our sole discretion to require further documentation to verify your information.

You may request access to a copy of your Personal Data which we possess by submitting your request at the contact details provided below. Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request.

We will need sufficient information from you to ascertain your identity and the nature of your request to be able to deal with your request. We reserve the right to refuse your access request or to correct your Personal Data in accordance with the provisions as set out in PDPA.

 

CHANGES

We may update this Policy from time to time without prior notice in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Your continued use of our Site constitutes your acknowledgement and acceptance of such changes.
